Section 1
Agreement to terms
In short
Using the Site means you accept these Terms and our incorporated policies.
The Site provides information about Spectrum's software development, AI, cloud, and consulting services. It is not an offer to provide regulated services (such as HIPAA-covered processing or financial advice) unless explicitly agreed in writing under a separate contract.
If you access the Site from outside India or the United States, you are responsible for compliance with local laws. The Site is not directed at jurisdictions where its content or use would be prohibited.
Persons under 18 may not use the Site or submit personal information without parental or guardian consent where required by law.
Section 2
Website terms vs. professional services
In short
Signed commercial documents control delivery work — not this webpage.
Requesting a quote, booking a call, or exchanging emails does not create a binding services agreement until both parties execute a proposal, statement of work, master services agreement, or equivalent document.
Pricing, timelines, intellectual property ownership, confidentiality, service levels, and acceptance criteria for client projects are defined in those commercial documents. Where a conflict exists between these Terms and a signed agreement for services, the signed agreement prevails for that engagement.
Section 3
Intellectual property
In short
Site content belongs to Spectrum or its licensors — limited personal use only.
Unless stated otherwise, the Site and all materials on it — including text, graphics, logos, icons, images, audio, video, software, and layout — are owned or licensed by Spectrum and protected by copyright, trademark, and other intellectual property laws.
You may view and download content for personal, non-commercial reference. You may not copy, modify, distribute, sell, scrape, frame, or create derivative works from Site content without our prior written consent, except where fair use or applicable law allows.
Section 4
Your responsibilities
In short
Use the Site lawfully, accurately, and without automated abuse.
By using the Site, you confirm that:
- You are at least 18 years old and have authority to accept these Terms
- Information you provide through forms or chat is truthful and kept current
- You will not use bots, scrapers, or automated tools to access the Site without permission
- You will not use the Site for unlawful, fraudulent, or harmful purposes
- Your use complies with applicable laws and regulations in your jurisdiction
Section 5
Acceptable use
In short
Do not interfere with the Site, other users, or Spectrum's systems.
You agree not to:
- Probe, scan, or test vulnerabilities or bypass security controls
- Upload malware, spam, or material that disrupts Site operation
- Harvest emails or user data for unsolicited marketing
- Impersonate Spectrum, our staff, or other visitors
- Reverse engineer or copy Site software except as law permits
- Use Site content to build a competing product or misleading offering
- Harass our team or abuse support channels with false reports
- Remove copyright or proprietary notices from materials
Section 6
Content and submissions
In short
Ideas, feedback, and files you send may be used to improve our services.
If you submit suggestions, feedback, RFP materials, resumes, or other content through the Site, you grant Spectrum a non-exclusive, royalty-free license to use that material to evaluate, respond to, and improve our services — unless a signed NDA or contract states otherwise.
You represent that you have the right to submit such content and that it does not infringe third-party rights. Do not submit confidential information you cannot share without an executed confidentiality agreement.
Public areas of the Site (if any) are not designed for sensitive personal or client data. You remain responsible for content you post or transmit.
Section 7
Third-party links and tools
The Site may link to third-party websites or embed tools (analytics, chat, social platforms). We do not control and are not responsible for third-party content, policies, or transactions. Your use of third-party services is at your own risk and subject to their terms.
Section 8
Site management
We may monitor use of the Site for security and compliance, remove content that violates these Terms, restrict access (including by IP address), and cooperate with authorities when required by law — without prior notice where permitted.
Section 9
Privacy
In short
Personal data is handled under our Privacy Policy and Cookie Policy.
Our Privacy Policy explains how we collect and process personal information. Our Cookie Policy explains how we use cookies and similar technologies. By using the Site, you acknowledge those policies.
Section 10
Copyright complaints
We respect intellectual property rights. If you believe material on the Site infringes your copyright, send a notice to [email protected] with: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and its location; (3) your contact details; (4) a good-faith statement that use is unauthorized; and (5) a statement under penalty of perjury that your notice is accurate and you are authorized to act on behalf of the rights holder.
We may remove or disable access to material that is the subject of a valid complaint and may terminate repeat infringers where appropriate.
Section 11
Suspension and termination
We may suspend or terminate your access to the Site at any time if we believe you violated these Terms or applicable law. Upon termination, provisions that by nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnity) will continue to apply.
Section 12
Availability and changes
We aim to keep the Site available but do not guarantee uninterrupted access. Maintenance, updates, or technical issues may cause downtime. We may change, suspend, or discontinue any part of the Site without liability.
Information on the Site may contain errors or become outdated. We may correct descriptions, case studies, or availability information at any time without notice.
Section 13
Governing law and disputes
In short
Indian law applies to these website terms; disputes start with good-faith discussion.
These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country provide otherwise.
Before formal proceedings, the parties agree to attempt good-faith resolution by contacting [email protected] for at least thirty (30) days. If unresolved, disputes arising from these Terms or use of the Site shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India, unless applicable law requires a different forum.
Disputes related to a signed services agreement are handled under the dispute clause in that agreement.
Section 14
Disclaimer
In short
The Site is informational only — provided without warranties.
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be error-free, secure, or free of harmful components. Case studies, blog articles, and marketing content are illustrative; results vary by project. Nothing on the Site constitutes legal, financial, medical, or professional advice.
Section 15
Limitation of liability
In short
Our liability for website use is limited to the extent permitted by law.
To the maximum extent permitted by law, Spectrum and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Site.
Our total liability for any claim related to the Site shall not exceed one hundred U.S. dollars (USD $100) or the minimum amount required by applicable law, whichever is greater. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
Section 16
Indemnification
You agree to defend and indemnify Spectrum against claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site, your submissions, your violation of these Terms, or your infringement of third-party rights — except to the extent caused by our gross negligence or willful misconduct.
Section 17
Electronic communications
You consent to receive communications from us electronically — including email and notices on the Site — and agree that such communications satisfy legal writing requirements where applicable. You agree to electronic records and signatures in connection with online forms and inquiries.
Section 18
California residents
If you are a California resident and have an unresolved complaint, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210.
Section 19
General provisions
These Terms, together with incorporated policies, are the entire agreement regarding Site use. Our failure to enforce a provision is not a waiver. If any provision is unenforceable, the remainder stays in effect. You may not assign your rights under these Terms; we may assign ours. We are not liable for delays caused by events beyond reasonable control.
